The Customer may review, complete, modify or cancel their order before validating it.

 

This validation implies prior knowledge and express and unreserved acceptance of the GCS and the Personal Data Protection Policy by the Client, by checking the corresponding box, and constitutes a payment commitment.

 

After validation of the order, the Customer selects the delivery address and payment method.

2- Product availability

The products available are those that appear on the Site, subject to the stocks available at Jordauto, previously agreed with its suppliers.

The Customer understands that the availability of the products, provided by Jordauto at the time of the order and confirmed in the order validation email, is for informational purposes only. Despite the constant updating of stocks, a variation may occur between the stocks shown on the Site during order validation and those actually available. Therefore, information about the availability of the products is provided at the time of order confirmation.

In case of lack of stock, Jordauto will try to find an equivalent product with the same technical characteristics, quality and price, and will propose a replacement product to the Customer.

If there is a price difference between the ordered product and the delivered product, it will be handled as follows:

  • If the value of the substitute product is higher than the price of the originally ordered product, the difference will not be charged to the Customer. Jordauto will assume the additional cost and will invoice the Customer for the price of the product requested.

  • If the value of the substitute product is lower than the price of the originally ordered product, the difference will be adjusted in favor of the Customer. Jordauto will update the price downwards and the amount charged to the Customer will be the price of the replacement product.

5. Shipping costs

Depending on the selected carrier, the package is delivered to a collection point against signature, to the home (with or without signature) or directly to the customer's mailbox.


Regardless of the method of delivery of the package, the Customer must check, at the collection point or with the delivery person, the condition of the package packaging at the time of delivery. In case of problem, the Client is invited to express his reservations in writing on the authorization sheet or in any other means presented for this purpose by the carrier. Once the reservations have been made, the Client will have the carrier sign the form and will keep a copy of it.

If the Client does not notify his reservations within the established period, he will be considered to have accepted the Products without incident, damage or anomalies. 8. Return of products

8.1 Right of withdrawal

Given the technical nature of some Products sold, the Customer must strictly comply with the technical specifications and safety recommendations of the manufacturer, in particular those relating to the storage, assembly and use of these Products.


The Customer must refer to the instructions for use and/or assembly provided with the requested Product.


Information on product properties and provisions for digital product updates can be found in the manufacturer's product sheet and in the technical documentation. Jordauto expressly points out that the product sheet may contain, (i) information about the characteristics of the product or (ii) contain various information about digital updates of the product.


By accepting these terms and conditions, the Customer accepts such different agreements regarding product functionality or updates.


The Client acknowledges that the proper functioning of the Site is subject to the conditions of access to the Internet network and its limits and restrictions (coverage, saturation, availability). Therefore, Jordauto cannot be held responsible in this regard.


The photographs and illustrations accompanying the Products on the Site have no contractual value. Jordauto advises the Customer to consult the Product sheet and, in particular, its description to know its precise characteristics. The information contained in these Product Descriptions comes from various sources (manufacturer's manuals, etc.), therefore, in case of doubt, or to obtain additional information, the Customer is invited to contact Customer Service of Jordauto.


Jordauto is not responsible for:

 

- Any damage resulting from the installation or use of the Products by the Customer.

- In case of incorrect, incomplete or incorrectly completed contact details by the Customer (delivery addresses , financial transactions: payments according to the method chosen by the Customer, transmission of RIB-IBAN to Jordauto for refunds, references of the Products entered by the Customer and identified by Jordauto on the Site, usurpation of customer account).

- Any event resulting from a case of force majeure that could delay or prevent the fulfillment of its obligations.

Except in the event of a public order or mandatory provision, with regard to damages that may result from non-compliance, total or partial, or negligent compliance with its contractual or extra-contractual obligations, Jordauto will will only be responsible for real and proven damages by the Client that are the immediate consequence thereof, without the total amount of damages to be paid by Jordauto, all of them combined generating events, exceeding the amount of the invoice of the sale in question.


This limit also applies to all consequences, including equivalent refunds, that could be imposed on Jordauto in the event of nullity or termination of a sale.


Jordauto will in no case be responsible for indirect damages suffered by the Client, such as, among others, loss of income, loss of business volume, loss of profits, loss of savings expected, or any indirect or derived damages, costs or expenses.

 

10.2 Guarantees


The Products sold by Jordauto to the Customer enjoy:


- The legal guarantee of conformity
- The legal guarantee of hidden defects


The legal guarantees, conformity and hidden defects, apply independently of any commercial guarantee that may be granted.


In order to activate these guarantees, the Client must keep the purchase invoice for the Product.

 

Legal guarantee of conformity

 

The action of legal guarantee of conformity by the Client is subject to the following legal regime:


- The Client has a period of one year from the delivery of the Product to act on any equipment sold that is first used or new.


Under the legal guarantee of conformity, the Client will have the right to obtain:

 

- Either the repair of the Product.
- Or the replacement of the Product.
- In the event that the repair or replacement is impossible or disproportionate, an appropriate reduction in the price will be made or cancellation of the order once the Product has been returned to Jordauto.

- If the allegedly defective Product appears to be the cause of damage to other parts, the Customer must contact Jordauto and not dismantle the Product in question. Jordauto can commission an independent automotive expert to determine the causes of the malfunction.

- If the alleged defective Product does not appear to have caused other failures, the Customer, to return the defective Product, must go to their account and select as the reason for the return: "The part received is defective."


Any invoice sent after the deadline and not in compliance will be definitively rejected, no additional request for reimbursement from Jordauto will be accepted.

Once the Product has been disassembled and returned, the customer can change its part if they wish. Jordauto does not grant any replacement loan to the Customer during the period of immobilization of the Products in question, for the purposes of warranty appraisal.

 

Warranty exclusion cases

 

The warranty will not be covered by Jordauto in the following cases:

- Normal wear and tear of the Product.

- Defects and consequences related to a Customer error, improper handling by the Customer, abnormal use of the vehicle on which the part is intended as a result of improper use or installation, improper assembly of the part or installation that does not comply with the specifications and recommendations of the equipment manufacturer or the automobile manufacturer.

- Storage detrimental to the conservation of the Product.

- Storage detrimental to the conservation of the Product.

- Damage resulting from a case of force majeure.

- Defects and consequences related to the modification, repair, integration or addition by the Client not in accordance with normal use.


In all these cases, Jordauto is not responsible for the defect of the Product or any damage caused.


In case of acceptance of the guarantee by Jordauto, if necessary after an analysis, Jordauto will repair, replace the Product or refund the Customer within a maximum period of time.

 

 

11. Force majeure

Jordauto cannot be held liable to the Client for any delay or failure to comply with one of its obligations in the event of force majeure. These cases include, but are not limited to: natural disasters, government actions, wars, attacks, fires, floods, explosions, blackouts, computer disturbances or civil unrest.


Jordauto reserves the right to suspend or terminate the Sale, in whole or in part, in the event of force majeure defined as any event that may stop, reduce, delay or cause the sale of the Products to be economically and significantly less profitable or prevent the normal execution of the sale.


The Client may not claim any compensation from Jordauto.



12. Personal data


Jordauto is responsible for the collection and processing of your personal data. We implement processes dedicated to managing services and relationships with our clients and prospects so that each of them can maintain and repair their vehicles.


Jordauto applies measures to guarantee the confidentiality, security and integrity of the Client's personal data, and undertakes that its service providers to whom it subcontracts the services guarantee the same level of security as its own. .


Jordauto expressly invites the Client to read its Personal Data Protection Policy.



13. Intellectual Property


The Client acknowledges that all content of the Site, including in particular: the domain name, trademarks, texts, graphics, photographs, drawings, sounds, data, images, The audio and video, as well as the Jordauto tree structure, the navigation plan, the logos, the design and organization of its sections, the titles, the databases, the structures and the contents, existing or future, are protected and are the exclusive property of Jordauto and/or its partners.


Consequently, without the prior and express authorization of Jordauto, all reproductions, representations and uses by the Client are prohibited.


Any failure to comply with these obligations by the Client would constitute an act of falsification.



14. Applicable law and conflict resolution

The CGV are subject to Spanish regulations.

If an amicable solution is not reached, any dispute will be submitted to the Spanish courts.
